These Payment Terms govern the use of the payment services provided by Circles between Experts and Clients. By using our platform, you agree to the terms set forth below, including any future modifications. Please read these terms carefully.
1. Payment Process for Experts
- Earnings: Experts will receive payments into their wallet after each chat session ends, meaning the subscription package is completed and the advisor has provided their services. Payments are processed after the chat session is closed, and the amount displayed in the wallet is the net amount after deducting Circles' commission. The commission fee is agreed upon individually with the influencer/expert and ranges from 10% to 20% depending on the terms set for each expert.
- Taxes: Experts are responsible for paying any direct or indirect taxes, including but not limited to GST, VAT, or income tax, which may apply to them depending on their location, residency, or jurisdiction.
- Payment Schedule:
- Billing Cycle 1: Payments for chats that are closed between Day 1 and Day 15 of any month will be processed and paid out on the 1st day of the following month.
- Billing Cycle 2: Payments for chats that are closed between Day 16 and the end of the month will be processed and paid out on the 15th day of the following month.
- There are two billing cycles per month: one on the 1st of the month and another on the 15th.
- Payment Method: Payments will be transferred to the influencer/expert via bank transfer in the local country currency. The payment processing will be handled by third-party Payment Service Providers who guarantee the security of transactions.
2. Investigation and Payment Hold
- Complaint Investigation: If a client files a complaint and an investigation is initiated, Circles may hold the money associated with the subscription until the investigation is complete. The outcome of the investigation will determine whether:
- The money is returned to the client,
- Or the money is released to the expert.
3. Subscription Cancellation and Refunds
- Cancellation Before Time-Based Session Start: If the client cancels the subscription before the expert starts the time-based session, the payment will be refunded to the client in full. Refunds will be processed via bank transfer to the same account that the payment was made from.
- Refund Process:
- Refund Timeline: Refund requests will be processed within 10 business days from the confirmation of the valid refund request.
- Refund Method: Refunds will be issued in the same currency as the initial subscription payment and processed via bank transfer (not automatically).
- Valid Refund Conditions: Refunds will only be issued in cases where it is determined, after investigation, that the expert did not provide the required service (e.g., failure to respond, refusal to give the paid service, etc...).
4. Promo Codes
- Use of Promo Codes: Promo codes may be provided either by Circles or the expert for discounts or special offers.
- Promo Code by Expert: The expert can provide promo codes to their clients, which can be redeemed for discounts on their services.
- Promo Code by Circles: Circles may also distribute promo codes to clients as part of special promotions or marketing campaigns.
- Conditions for Promo Codes: Each promo code may have specific terms and conditions, including expiry dates, usage limits, and eligibility criteria.
5. Viewing Wallet and Subscription Details
- Expert Wallet: Experts can view their wallet, including:
- Net Balance
- Commission Fees deducted by Circles
- On-Hold Fees during investigations
- List of Subscriptions including transaction details for each session.
- Client Subscription Details: Clients will be able to view a history of their subscriptions, including:
- Payment details
- Advisor information
- Dates of consultations
- Subscriptions Status
6. Billing and Payment Terms
- Fees for Clients: Clients will pay only the fees explicitly mentioned in the app for each expert. They are not allowed to pay any extra fees directly to the expert that is not specified in the app. Any additional charges outside of the platform will not be processed or supported by Circles.
- Payment Method for Clients: Payments from clients will be made exclusively via credit card, processed securely through Payment Service Providers. Circles does not guarantee the quality of services provided by the experts and will not be responsible for any disputes related to service quality.
7. Changes to Payment Terms
Circles reserves the right to make changes to these Payment Terms at any time. When changes are made, Circles will update the Payment Terms on this page, and a new copy will be made available to users.
8. Disclaimer of Warranties
- No Warranty for Services: Circles does not provide any warranties regarding the quality of services provided by experts. All consultations and services are provided by the individual expert, and Circles does not guarantee their quality, effectiveness, or satisfaction. Clients must directly interact with the expert for any service-related concerns.
- No Liability for Disputes: Circles’ customer support will not be responsible for resolving disputes related to the quality of the services rendered by the expert. Any disputes regarding the content of the service will need to be directly handled between the client and the expert.
9. General Payment Terms
- Currency: All payments will be processed in the local country currency and the refund will be sent in the same currency that the client initially used to subscribe to the service.
- Security: All transactions are securely processed through third-party Payment Service Providers, which ensure that client and expert information is kept confidential and protected.
Final Notes
By accepting these Payment Terms, both clients and experts agree to the conditions outlined above. We aim to create a secure, transparent, and fair environment for all users of the Circles app.
